The website is owned and operated by 555714 BC Ltd. from British Columbia, Canada. Unless otherwise stated on your quote, invoice, order confirmation, or written agreement, sales in Canada are fulfilled by 555714 BC Ltd., and sales in the United States are fulfilled by Brikers US Inc., a Delaware corporation.

By using this website, you agree to these Terms of Use. If you do not agree with these Terms, please do not use the website. If you use the website on behalf of a business, organization, or other entity, you represent that you have authority to bind that entity to these Terms. In that case, "you" and "your" refer to both you and that entity. You represent that you are at least the age of majority in your jurisdiction and have the legal capacity to enter into these Terms.

These Terms apply to your use of the website. Purchases, quotes, invoices, warranties, returns, core charges, credit accounts, and other transactions may also be governed by separate written terms, policies, quotes, invoices, or agreements. If there is a conflict between these Terms and transaction-specific terms provided by Brikers, the transaction-specific terms will apply to that transaction.

Brikers gives you a limited, non-exclusive, revocable, and non-transferable right to access and use the website for lawful purposes, including researching parts, requesting quotes, reviewing product information, creating an account, or communicating with our team.

You agree not to use the website in any way that could damage, disable, overload, interfere with, or impair the website or any systems connected to it. You also agree not to use the website in a way that violates any law, infringes the rights of another person or business, or interferes with another user's ability to use the website.

2. Accounts and Login Information

You are responsible for confirming that any part is suitable for your equipment before purchase, installation, or use. This may include verifying part numbers, serial numbers, equipment make and model, measurements, condition, configuration, and application requirements.

Brikers may ask for additional information to help identify the correct part. This may include photos, serial numbers, casting numbers, part numbers, machine details, measurements, or other information. Providing complete and accurate information helps us serve you better, but final fitment and installation decisions remain your responsibility.

4. Quotes, Orders, Pricing, and Availability

Information shown on the website does not guarantee that a product is in stock, available for sale, or available at a particular price.

A quote, cart entry, order request, confirmation message, or website submission does not automatically mean that Brikers has accepted an order. Unless Brikers states otherwise in writing, an order is accepted only when Brikers confirms acceptance, availability, pricing, payment terms, and any applicable shipping or delivery details.

Brikers may correct pricing errors, product errors, availability errors, or other mistakes at any time. We may refuse, cancel, or limit any order or quote request where information is inaccurate, unavailable, incomplete, or inconsistent with our policies.

Prices do not include taxes, duties, customs charges, shipping, freight, handling, insurance, brokerage, or other charges unless clearly stated in writing.

5. Shipping, Customs, and Import Requirements

Shipping dates, delivery windows, transit times, and freight estimates are estimates only unless Brikers expressly agrees otherwise in writing.

You are responsible for providing accurate shipping information and for complying with all applicable import, export, customs, and regulatory requirements. You are also responsible for any duties, taxes, fees, customs charges, brokerage charges, or other costs related to shipment unless Brikers has expressly agreed otherwise in writing.

Risk of loss, title transfer, shipping terms, and delivery responsibilities may be addressed in the applicable quote, invoice, purchase terms, or written agreement.

You agree to comply with all applicable import, export control, customs, sanctions, and trade compliance laws and regulations, including those of Canada and the United States. You may not purchase, export, re-export, transfer, or use any product or service from Brikers in violation of applicable law, including for restricted end uses, restricted destinations, or restricted parties. Brikers may refuse, cancel, suspend, or delay any quote, order, shipment, or transaction where Brikers believes that doing so is necessary to comply with applicable trade compliance requirements.

6. New OEM Surplus, Rebuilt, Aftermarket, and Used Parts

Brikers may offer new OEM surplus, rebuilt, aftermarket, used, parts and components. Product conditions will be described based on the information reasonably available to Brikers at the time.

Photos, descriptions, and condition notes are provided for reference. They may not show every mark, difference, wear item, configuration detail, or included component.

Unless stated otherwise in writing, product warranties, return rights, core charges, and claim procedures are governed by the applicable Brikers warranty policy, return policy, quote, invoice, or written agreement.

7. Installation, Safety, and Equipment Operation

Parts and components should be inspected and installed by qualified personnel. You are responsible for ensuring that any product purchased from Brikers is installed, tested, maintained, and operated safely and correctly.

Website content is not a substitute for manufacturer manuals, service procedures, safety bulletins, technical training, professional advice, or qualified mechanical judgment.

To the fullest extent permitted by applicable law, Brikers is not responsible for damage, downtime, injury, loss, or other issues arising from improper installation, improper use, failure to inspect, incorrect fitment, unauthorized modifications, unsafe operation, or failure to follow applicable service and safety requirements.

8. Manufacturer Names, Trademarks, and OEM References

The website may reference equipment manufacturers, brand names, model names, part numbers, logos, or trademarks, including names such as Caterpillar, John Deere, Hitachi, Komatsu, Volvo, CASE, Kobelco, Link-Belt, and others.

Use of OEM part numbers, manufacturer names, model names, or compatibility references does not mean that a product is manufactured by, sourced from, approved by, or endorsed by the original equipment manufacturer unless Brikers expressly states otherwise.

All trademarks, logos, brand names, and product names belong to their respective owners.

9. Website Content and Intellectual Property

The website, including its text, images, graphics, logos, videos, layout, design, product descriptions, databases, downloadable materials, and other content, is owned by Brikers or used by Brikers with permission.

You may view and use website content for your own lawful business or personal purposes related to evaluating or purchasing products from Brikers. For claims related to a product purchase, warranty, return, core, freight issue, or other transaction, Brikers' liability, if any, will be governed by the applicable quote, invoice, warranty policy, return policy, sales terms, or written agreement.

Nothing in these Terms limits liability that cannot be limited under applicable law.

19. Indemnification

You agree to defend, indemnify, and hold harmless Brikers and its directors, officers, employees, contractors, suppliers, licensors, and service providers from and against any claims, demands, losses, liabilities, damages, costs, and expenses, including reasonable legal fees, arising from or related to:

Your purchase of products is separate from your use of the website. Each sale is governed by the terms, governing law, and forum set out in the quote, invoice, order confirmation, or other written agreement issued by the Brikers entity that makes the sale, and not by this section. Sales made by 555714 BC Ltd. are governed by the laws of British Columbia and the federal laws of Canada that apply there.

Sales made by Brikers US Inc. are governed by the laws of the State of Delaware and the applicable federal laws of the United States. Unless the applicable quote, invoice, order confirmation, sales terms, or written agreement states otherwise, disputes relating to sales made by Brikers US Inc. will be resolved exclusively in the state or federal courts located in Delaware. Where there is a conflict between this section and the terms governing a specific sale, the terms governing that sale control for that transaction.

Before starting a legal claim, you agree to provide Brikers with written notice of the dispute and give Brikers at least 30 days to try to resolve the issue informally, unless applicable law requires otherwise.

23. Electronic Communications

When you use the website, submit a form, create an account, request a quote, place an order, or email Brikers, you are communicating with us electronically.

You agree that Brikers may communicate with you electronically, including by email, website notices, account notices, quote communications, order communications, and other electronic messages.

Marketing emails, SMS messages, and other promotional communications will only be sent where permitted by applicable law and are subject to any consent, unsubscribe, and opt-out requirements that apply.

You may not assign or transfer your rights or obligations under these Terms without Brikers' prior written consent.

Brikers may assign or transfer these Terms in connection with a merger, acquisition, sale of assets, corporate reorganization, or transfer of business operations.

27. Language

It is the express wish of the parties that these Terms and all related documents be written in English.
